Win for SRBC Client in Insurance Coverage Dispute Title Withheld SRBC recently succeeded in obtaining summary judgment in favor of an insurance-company client in a dispute over an umbrella policy and responsibility for a $2 million settlement arising from an automobile accident. The settling plaintiffs, acting as assignees of the company's insured, claimed that an insurance agent acted improperly in procuring the policy at issue, and that the insurer, SRBC's client, was vicariously liable for the agent's conduct. A superior court judge agreed with SRBC that the agent was acting on behalf of the insured, not the insurance company, when it obtained the policy, precluding vicarious liability. The court also barred the plaintiff from amending the complaint to add new claims against the carrier, finding the proposed new claims untimely and meritless.
